Announces Settlement of Mobile
Clinical Workstation
Patent Rights Case
Atlanta, GA– December 20,
2004 – Flo Healthcare Solutions,
LLC, a leading producer of state-of-art
wireless mobile workstations, wireless
infrastructure, and related services
for the healthcare industry, today
announced settlement of a lawsuit
regarding patent rights of the
Mobile Clinical Workstation of
Flo Healthcare (US Patents 6,493,220
and 6,721,178). The settlement
resolves all claims asserted in
a lawsuit in which it had alleged
infringement of certain of Flo
Healthcare's patent rights by Jaco,
a former supplier, and Info Logix,
a distributor of competitive products.
(Flo Healthcare acquired the patent
rights and the plaintiff's rights
in the lawsuit when it acquired
the medical workstation business
in October of 2003.)
The patent for the Mobile Clinical Workstation covers many of the essential,
industry-standard features of the cart-based form factor in a mobile workstation,
which is equipped with a computer and power supply, and is connected wirelessly
to a local area network by WiFi access points. Flo Healthcare, formerly EMS
Wireless Healthcare, developed the technology for cart-based systems, which
enable medical facilities to enhance patient safety and realize the full benefits
of clinical applications through the use of point-of-care devices.
The settlement agreement resolves all claims and counterclaims between the
parties. In exchange for undisclosed amounts, Jaco and Info Logix received
from Flo Healthcare a perpetual, worldwide license to produce and sell products
under Flo's patent rights, subject to certain contractual limitations. As part
of the settlement, Jaco and Info Logix acknowledged the validity and enforceability
of Flo Healthcare's patent rights. Additionally, Flo Healthcare and Info Logix
have entered into a Value-Added Reseller Agreement pursuant to which Info Logix
will distribute Flo Healthcare's workstations. "
